Acceptance of Terms
By accessing and using bizluv (the "Service"), operated by Untamed Orange Apps LP, a Missouri limited partnership ("bizluv," "we," "our," or "us"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
Description of Service
bizluv is a loyalty and referral platform for small businesses. Business owners create offers (discounts or rewards); referrers share those offers with others; and referees redeem them. bizluv facilitates these connections and tracks each offer through its lifecycle (assignment, redemption, approval, and reward). We are not directly responsible for the underlying goods or services provided by the businesses participating in our network.
User Accounts and Registration
Account Creation
You may be required to create an account to access certain features. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
Account Eligibility
You must be at least 18 years of age to use the Service.
SMS / Text Messaging
If you provide your mobile phone number and opt in during signup, you consent to receive SMS text messages from bizluv (operated by Untamed Orange Apps LP) for account notifications and authentication related to your own account.
- Message frequency: up to 60 messages per month.
- Standard message and data rates may apply.
- Reply STOP to opt out at any time; reply HELP for help, or contact support@bizluvapp.com.
- Your mobile opt-in information and SMS consent are not shared with third parties or affiliates for marketing. See our Privacy Policy for details.
User Conduct and Responsibilities
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit harmful, fraudulent, or malicious content
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of the Service
- Harass, abuse, or harm other users
- Use automated systems to access the Service without permission
Data Sharing and Consent
By using bizluv, you acknowledge and agree that:
- Information you submit may be shared with other bizluv users and with participating businesses solely to operate the referral and redemption flows you initiate (for example, sharing an offer with a referee or redeeming it against a business's offer)
- We do not sell your information, and we do not share your mobile phone number or SMS opt-in consent with third parties or affiliates for marketing purposes
You retain ownership of any content you submit but grant us a license to use, display, and share that content as necessary to operate the Service and fulfill your requests.
Third-Party Businesses
Our Service may connect you with participating businesses. We are not responsible for:
- The quality, accuracy, or legality of goods or services provided by those businesses
- The actions, content, or policies of participating businesses
- Any transactions or disputes between you and those businesses
Your interactions with participating businesses are solely between you and them.
Intellectual Property
The Service, including its content, features, and functionality, is owned by Untamed Orange Apps LP and protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or create derivative works
- Reverse engineer or attempt to extract source code
- Remove or alter proprietary notices
Disclaimers and Limitations of Liability
Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIZLUV AND UNTAMED ORANGE APPS LP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.
Indemnification
You agree to indemnify and hold harmless bizluv
and Untamed Orange Apps LP, its affiliates, and their respective officers, directors, and employees from any claims, damages, losses, liabilities, and expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Content you submit to the Service
Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for:
- Violation of these Terms
- Fraudulent or illegal activity
- Extended periods of inactivity
- Upon your request
Upon termination, your right to use the Service immediately ceases.
Modifications to Service and Terms
We reserve the right to:
- Modify or discontinue the Service at any time
- Update these Terms periodically
Continued use of the Service after changes constitutes acceptance of modified Terms. Material changes will be communicated through the Service or via email.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Missouri, without regard to conflict-of-law principles.
Any disputes arising from these Terms or the Service shall be resolved through:
1. Good faith negotiation
2. Binding arbitration (if negotiation fails)
3. Courts located in the State of Missouri (for matters not subject to arbitration)
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and bizluv regarding the Service and supersede all prior agreements.
